Judge condemns cyberbullying in Joshlin Smith trial! As the Joshlin Smith trial entered its fifth week on Tuesday in Saldanha, Western Cape, presiding Judge Nathan Erasmus took a strong stance against cyberbullying and AI manipulation targeting those involved in the case.

Judge Erasmus Addresses Cyberbullying

Before court proceedings began, Judge Erasmus took time to address concerning reports of cyber harassment affecting both the State and defence lawyers.

“It has come to my attention that the State and defence counsels have become victims of cyberbullying and AI manipulation of sound,” the judge said.

His statement followed the weekend circulation of a viral TikTok video that put a defence lawyer under public scrutiny.

One of the defence counsels, Nobahle Mkabayi, who is representing Steveno van Rhyn, found herself at the centre of online controversy after a video clip went viral on TikTok.

In the clip, which was allegedly recorded after court had adjourned, Mkabayi was heard making a comment suggesting that Judge Erasmus was racist.

This video, reportedly manipulated using AI, gained traction on social media, sparking debates and drawing criticism from online users.

False Allegations on Social Media

Judge Erasmus also condemned the spread of misinformation on social media platforms, where TikTok users have been accusing various legal officials of being involved in the disappearance of Joshlin Smith.

One social media user, who claimed to be acting on “divine revelations,” posted a list of individuals, including the judge himself, alleging they played a role in the case.

Judge Erasmus dismissed these claims, saying:

“People have been spreading stories, including of myself, being part of the disappearance of Joshlin. Maybe these are the signs of the times … We will not be deterred by these individuals who try to undermine the processes of the court. We shall act without fear or favour.”

Courtroom Rules Strengthened

Following the online attacks, Judge Erasmus imposed new measures to maintain courtroom integrity and media conduct.

• He ordered that no microphones remain live once he adjourns the court.

• Media personnel have been barred from the section where legal counsels are seated.

• He warned that failure to adhere to these arrangements would result in individuals being removed from the courtroom.

“Failing to adhere to the arrangements, I won’t hesitate to remove people from this court,” he cautioned.

These measures aim to protect the judicial process from external interference and ensure a fair trial.

Investigator’s Cross-Examination Continues

Despite the online distractions, the court proceedings resumed with Detective Captain Wesley Lombard, the lead investigating officer, returning to the witness stand.

The defence lawyer, Nobahle Mkabayi, continued her cross-examination of Lombard, challenging his testimony and the evidence presented by the State.

The trial is expected to continue, with legal teams navigating through intense scrutiny from both the media and the public.
