Manager: Risk & Compliance

Minimum Appointment Requirements
Matric/Grade 12 Certificate; ▪ NQF Level 7 in Finance or Law; ▪ Certification in Risk & Compliance; ▪6 years post qualification experience, of which 4 years is in a supervisory capacity; ▪NQF Level 8 in Finance or Law is advantageous; ▪ Admission as an attorney is advantageous; ▪6 years post qualification experience in a professional regulatory environment, of which 4 years is in a supervisory position is advantageous; ▪Legal Practice Act, No 28 of 2014; ▪Section 109 Regulations; ▪Code of Conduct for all Legal Practitioners, Candidate Legal Practitioners and Juristic Entities; ▪Rules of LPC; ▪Financial Principles ;▪Risk
management; ▪Required to travel locally.

Key Responsibilities
Monitor compliance of legal practitioners to applicable legislation and regulations; ▪Review assessments of general status of affairs of a legal practice ; ▪Review forensic reports on evidence collated and findings; ▪Monitor the presentation of findings and evidence provided at disciplinary enquiries and Court; ▪Manage the provision of control systems to prevent or deal with violations of legal guidelines and internal policies; ▪Ensure the optimization and utilization of automated system processes ▪Manage the winding up of practices of members that have been suspended, struck or are deceased; ▪Monitor the timeous
and efficient handling of claims lodged against the trust account; ▪Monitor the administration of trust accounts of suspended, struck or deceased members; ▪ Liaise with relevant stakeholders i.e. liquidators, banks, AFF, etc. ; ▪Monitor compliance to court orders and approach court with regards to defects in court orders; ▪Manage the investigation of financial discrepancies and misappropriation of trust funds held by legal practitioners; ▪Review forensic reports on evidence collated and findings;
▪Monitor the presentation of findings and evidence provided at disciplinary hearing and Court; ▪Monitor the timeous and accurate capturing and processing of audit reports ; ▪Monitor the timeous and accurate processing of qualified audit reports ; ▪Monitor the collection and recording of trust interest ; ▪Manage the trust interest process in respect to Accounting to the AFF ▪Manage the annual trust audit ; ▪Manage and sign off the processing of Refund Applications ; ▪Monitor the receiving, processing and sending of correspondence related to Trust Accounting ; ▪Manage and oversee Payment/Recon of Legal Costs
and reclaiming same from LPFF insofar as it relates to Trust Accounting matters; ▪Attend Council meetings and provide insight on disciplinary matters ; ▪Produce reports on activities within the Department; ▪Provide instruction and liaise with members on striking and suspensions; ▪Handle queries from Councillors; ▪Review and update departmental policies and procedures and monitor the implementation therein; ▪Prepare the annual budget for the department and submit for approval; ▪Monitor
expenditure against budget in accordance with financial policy and procedures; ▪Produce reports on the performance of the department; ▪Participate in the recruitment of subordinates in consultation with the Human Resource Department; ▪Develop performance contracts for subordinates and conduct performance reviews to measure performance against agreed objectives, identifying training needs; ▪Provide guidance, coaching, mentoring and advice to subordinates; ▪Address discipline and
workplace conflict through consultation with the Human Resource Department; ▪Manage time, work allocations and leave of subordinates ; ▪Monitor compliance to company policies and the required codes of conduct, ethics etc.

Matric/Grade 12 Certificate; ▪ NQF Level 7 in Finance/ Law/ Compliance or Risk Management; •Certified Compliance Practitioner (CISA) ; ▪ Certified Fraud Examiner (ACFE) ; ▪ Certified Ethics Officer (TEI) ; ▪ Certified Risk Management Practitioner (IRMSA); ▪6 years’ experience in compliance and risk management, of which 4 years is in a management capacity; ▪ NQF Level 8 in Business Admin/ Law/ Compliance or Risk Management is advantageous; ▪ Certification in Risk OR Compliance (IRMSA, CISA) is advantageous; ▪6 years’ experience in compliance and risk management, within a legal

Key Responsibilities
▪Produce reports on the performance of the department; ▪Compile and maintain a risk register for submission to the Risk and Compliance Committee and Council; ▪Assist LPC Management in development of new Policies to incorporate regulatory requirements; ▪Develop and facilitate implementation of Risk Appetite and Tolerance Framework; ▪Promote and facilitate the identification, assessment and management of risks (strategic and operational) across the Organisation; ▪Coordinate and
monitor the LPC’s risk management process; ▪Implement the organisation’s risk assessment methodology across the organisation; ▪Monitor the reporting of risks across the organisation; ▪Promote risk management awareness across the LPC and provide education and training on risk; ▪Design risk management standards, frameworks and ensure that these are consistently applied throughout the organisation; ▪Facilitate the implementation of this strategy throughout the LPC; ▪Provide
relevant advice on risk management matters to all relevant stakeholders in the organisation; ▪Maintain and monitor the organisation’s enterprise-wide risk profile/ register; ; ▪Identify and assess fraud risks across the organisations and compiling the fraud risk register; ▪Compile fraud risk monitoring reports for review by the Risk and Compliance Committee and the Council; ▪Conduct organisation-wide fraud risk training; ▪Investigate internal fraud allegations reported through the whistle-blowing hotline; ▪Present the fraud investigations reports to the Risk and Compliance Committee and the Council; ▪Identify fraud risk
indicators and assist management to implement internal controls for mitigating the indicators; ▪Monitor compliance of legal practitioners to applicable legislation and regulations; ▪Address LPC compliance requirements relating to FICA, SARS, POPIA, PAIA and other applicable legislative requirements; Conduct Compliance Regulatory Universe Workshops;▪Identify and communicate LPCs compliance obligations (compliance requirements and compliance commitments; ▪Analyse regulatory requirements relating to Compliance issues and compile and consolidate the organization’s regulatory universe; ▪Conduct
compliance risk assessments with directors and senior managers; ▪Conduct Compliance Monitoring on the CRMPs; ▪Liaise with Regulators to ensure effective implementation of regulatory requirements for LPC ensure submission to Regulators and Other External Stakeholders; ▪Develop and facilitate implementation of Ethics Management Framework; ▪Presenting quarterly ethics reports to the RCC; ; ▪Attend Council meetings and provide insight on risk and compliance matters; ▪Prepare the Committee Agenda, Review of Committee minutes, review of action list; ▪ Participate in the recruitment of subordinates in

Key Responsibilities
Risk Identification, Assessment, and Mitigation / Control, Risk Monitoring, Risk Reporting; ▪ Assisting in the implementation of the approved risk management plan; ▪Assist National Office and Provincial Offices with monitoring the risk register; ▪Keep abreast of trends in risk and compliance; ▪Monitor the implementation of risk management framework and policy; ▪Assist the Risk Champions on risk and compliance concerns escalated to National Office; ▪Coordinate training across LPC (National and
