Gauteng Health Department to challenge court ruling on cancer treatment crisis! The Gauteng Department of Health (GDoH) has announced its plan to challenge a recent court ruling that declared its failure to provide radiation oncology services as unlawful and unconstitutional.

This legal battle stems from a case brought by Cancer Alliance, an advocacy group fighting for cancer patients’ rights, after the department allegedly failed to provide life-saving treatment to thousands of patients.

Cancer Patients Left Waiting for Years

According to court documents, the case highlighted a critical backlog of cancer patients in Gauteng waiting for radiation oncology treatment.

A report from March 2023 showed that at least 2,400 cancer patients were on a waiting list for treatment, with some having waited for over three years.

Despite funds being allocated two years ago by the Gauteng Treasury, delays in procurement processes prevented the department from acquiring the necessary equipment and resources to clear the backlog.

Court Ruling: A Victory for Cancer Patients?

In its ruling, the court ordered the department to:

  • Update the backlog list within 45 days.

  • Submit a progress report on efforts to provide radiation oncology services.

The judgment was seen as a victory by patient rights groups, who have long criticized the Gauteng Health Department for failing to deliver timely cancer treatment.

Gauteng Health Department Fights Back

However, the GDoH has responded by filing an application for leave to appeal the judgment.

Gauteng Health spokesperson Motalatale Modiba stated that the department’s legal team had identified substantive grounds for an appeal.

“Having carefully considered and studied the judgment and order, the legal team representing the GDoH is of the view that there are several substantive grounds of appeal, which if left unchallenged, will be greatly prejudicial to the patients undergoing radiation oncology services at the GDoH’s hospitals and may set an undesirable precedent.”

Why Is the Health Department Appealing?

While the department has not disclosed all the details of its appeal, it appears to be arguing that the ruling could negatively impact the provision of radiation oncology services and potentially set a legal precedent that may complicate future healthcare policies.

Critics, however, argue that the government should focus on fixing the system instead of challenging the ruling in court.

Cancer Alliance and Public Reaction

Following the judgment, Cancer Alliance welcomed the court’s decision, calling it a step toward holding the government accountable.

“The reality is that thousands of cancer patients are suffering due to government inefficiency. The court’s ruling simply demands that they do their job,” said a spokesperson for the advocacy group.

The ruling has also sparked public outrage, with many South Africans questioning why patients must fight for access to essential healthcare services.

The Future of Cancer Treatment in Gauteng

With the department now challenging the judgment, the fate of thousands of cancer patients remains uncertain.
